A Salisbury resident has been prosecuted by Wiltshire Council after breaching a Community Protection Notice (CPN), which was issued to address ongoing antisocial behaviour.
A CPN is a legal tool used by local authorities and the police to tackle persistent antisocial behaviour that has a negative impact on the quality of life of people in the area. It sets out clear requirements to stop specific behaviours and, where necessary, take steps to prevent further issues.
Mr Michael Babey, of Whatcombe Brow, Salisbury, pleaded guilty to a breach of his CPN at Salisbury Magistrates’ Court on Thursday, 28th May. The court heard that he deliberately engaged with a neighbour in an intimidating manner, contrary to the requirements of the CPN, including using abusive and degrading language.
Magistrates also heard that the behaviour formed part of ongoing issues, despite previous attempts to address the situation through formal intervention.
Mr Babey was fined £249, ordered to pay a £100 victim surcharge, and £2,000 in prosecution costs, bringing the total to £2,349.
He was originally served with the CPN on 24 April 2024. Despite this intervention, a breach of the CPN was reported on 1 March 2025.
Mr Babey initially pleaded not guilty at Salisbury Magistrates’ Court on 5 June 2025, and a trial was listed for 28 May 2026.
A two-year injunction was granted in September 2025 to protect the affected neighbour while the case progressed.
At the court on 28 May, Mr Babey changed his plea to guilty and was fined, and was advised that further court action may be taken if he fails to pay.
Cllr Paul Sample, Cabinet Member for Environment, which includes Public Protection, said: “We take incidents of antisocial behaviour very seriously, particularly where they have a continued impact on residents’ quality of life.
“Community Protection Notices are only issued where there is a clear and persistent impact on others, and in this case, they were put in place to address ongoing antisocial behaviour.
“We will continue to take appropriate enforcement action where necessary to protect residents and maintain community safety.”
